Terms of Sale & Use
These terms apply when you buy from Loutre et Lys, commission work, or use this website. Please read them before you order. Nothing here affects your statutory rights as a consumer.
1. Who we are
Loutre et Lys is the trading name of an independent artist based in Dorset, England.
Our full trading name and address are published here before the shop opens.
Email: [email protected]. We are not registered for VAT, so no VAT is added to our prices.
2. The work
- Originals are one-of-a-kind, hand-painted pieces, signed by the artist.
- Limited-edition prints are numbered and signed. The edition size is stated for each print and will not be exceeded at that size.
- Open-edition prints and posters are printed to order or in small runs and may be signed.
- Every piece is made by hand or finished by hand. Brushwork, wood grain, paper texture and small variations are part of the work, not faults.
- Colours on screen depend on your device. We photograph each piece carefully, but the colour of the actual work may differ slightly from what you see.
- Frames are not included unless the listing says so.
3. Prices and payment
- Prices are in pounds sterling. Delivery is shown at checkout before you pay.
- Payment is taken by Stripe on its secure checkout. We never see or store your card details.
- Your order is accepted when we email to confirm it. If a piece has sold elsewhere or a price was shown in error, we will tell you promptly and refund you in full.
4. Delivery
Dispatch times, delivery charges and how we pack each piece are set out on our Delivery & Returns page, which forms part of these terms. Unless we agree otherwise, we will deliver within 30 days of accepting your order.
5. Your right to cancel
- When you buy online, you can cancel within 14 days of receiving your order, without giving a reason. The full process is on the Delivery & Returns page.
- This right does not apply to anything made to your specification or clearly personalised. That covers commissioned paintings, murals, personalised prints and custom sizes (Consumer Contracts Regulations 2013, reg. 28).
6. If something is wrong
- If a piece arrives damaged, faulty or not as described, tell us as soon as you can, ideally within 48 hours, with photographs of the piece and its packaging. That lets us claim from the carrier.
- We will repair, replace or refund, as the Consumer Rights Act 2015 provides.
- Your legal rights do not depend on the 48-hour request.
7. Commissions and murals
- We agree the design, size, price, timescale and, for murals, access and preparation in writing before work starts.
- Deposit: a 50% deposit secures your place and covers design work. The balance is due before dispatch or, for murals, on completion.
- Revisions: two rounds of changes to the design sketch are included. Later changes, or changes after painting begins, may be charged at an agreed rate.
- Cancelling a commission: you can cancel by email at any time. We keep the part of the deposit that reflects work done and materials bought. If the deposit is more than that, we refund the difference. If the work done is worth more than the deposit, we may invoice the difference.
- Murals in your home: where we agree a mural at your home, you have 14 days to cancel. If you ask us to start within those 14 days and then cancel, you pay for the work done up to that point.
- Timescales are good-faith estimates. We will keep you informed if anything changes.
- Murals: you own the painted wall or surface. You are responsible for a sound, prepared surface, safe access and any permission you need, such as from a landlord.
8. Copyright and how you may use the artwork
All artwork, designs, illustrations, photographs and text by Loutre et Lys are protected by copyright under the Copyright, Designs and Patents Act 1988 and international law. Copyright belongs to the artist.
- Buying a piece gives you the physical work only. It does not transfer copyright or any right to reproduce the image.
- You may display, sell or give away the physical piece you bought. You may photograph it in your home for personal use and share that photograph, crediting Loutre et Lys.
- Without our written permission, you may not copy, print, scan, trace or adapt the artwork. You may not use it on products, textiles, wallpaper, packaging, logos, tattoos, NFTs or in any commercial or promotional material. You may not upload it to print-on-demand or stock-image services, or present it as your own.
- Commissions and murals: copyright stays with the artist unless we agree otherwise in writing. We do not reproduce a private commission as a print without your agreement, and we never publish your address. We may photograph the finished work for our portfolio.
- Moral rights: the artist asserts the right to be identified as the creator of all Loutre et Lys work and the right to object to derogatory treatment of it (sections 77 and 80 of the Act).
